Victoria’s answer is not one blanket “legal” or “illegal” label. The result depends on what the item is, who is supplying it, the buyer’s age and the place where it would be used. The Victorian Department of Health and the TGA publish different parts of that answer. This guide maps the current source wording to the decision a reader actually needs to make.
Sources checked: 24 August 2026. This is an orientation guide to official rules, not legal or medical advice. A pharmacy must assess an individual therapeutic request; a venue or employer may also apply a policy that is stricter than the minimum state rule.
Start with the supply pathway
The clearest current Victorian statement is on the Department of Health’s information for pharmacists page. The page states that, from 1 July 2024, the rules apply to all e-cigarette products, including devices, vaping liquids and cartridges, regardless of nicotine content or therapeutic claims. It describes supply through a pharmacist working in a registered pharmacy or directly from a medical practitioner or nurse practitioner who has the patient under their care. It also states that tobacconists, vape shops and convenience stores cannot supply any type of vaping product. These are the Department’s current source conditions; they are not a conclusion that an unnamed listing or transaction has been assessed.
That is a description of the regulated pathway, not a finding about a particular online listing. A product page, marketplace post or social-media advert cannot prove that the seller, item or transaction meets the pathway. For a therapeutic-vaping question, read the current TGA framework and ask the responsible pharmacist or prescriber.

Federal and Victorian layers are related but not interchangeable
The TGA says the Commonwealth framework commenced on 1 July 2024 and regulates importation, domestic manufacture, supply, commercial possession and advertising of all vapes. It also describes vapes as including devices, accessories and substances. Victoria’s pharmacist guidance supplies the state-facing pathway and age conditions above. Neither page makes a particular retailer listing, coil, flavour or online transaction automatically acceptable without checking the item and channel.
For a buyer, the useful sequence is therefore: identify the item; identify the supplier; check the Victorian pathway; then ask the pharmacist or prescriber about the therapeutic conditions. Do not use a state public-place rule to answer a Commonwealth supply question, or use a national TGA description to infer that a non-pharmacy retailer may supply a product.
Where vaping is prohibited in Victoria
The Department’s smoke-free and vape-free areas page states that smoking and vaping are prohibited in all enclosed workplaces and specified public places. The examples below are deliberately short; the linked page is the controlling list and was updated on 29 April 2026.

Venue signs and workplace policies can add practical restrictions, but they do not make an unclear state category clear. Conversely, the absence of a sign is not evidence that a place is outside the statutory list. When the location is unclear, record it as unknown, ask the venue and read the Department’s named category before vaping.
A four-question Victoria check
- Supply: Is the question about a device, liquid, cartridge or another vaping product, and is the proposed supplier a pharmacist/registered pharmacy or a direct practitioner pathway?
- Age and patient context: Is the person 18 or over, and is the question about a therapeutic product that requires professional assessment? Do not self-apply the 20 mg/mL statement.
- Place: Is the exact area an enclosed workplace, outdoor dining/drinking area, public transport setting, listed entrance, recreation area, pool or patrolled beach?
- Evidence date: Save the rule owner’s page and the date checked. A retailer page can show what is advertised, but it cannot replace the Victorian Department of Health or TGA source.

Do not use this guide to decide a pending enforcement matter, an employment dispute, a person’s medical treatment, an under-18 transaction or the legality of a particular imported product. Use the linked authority, ask a registered health professional where therapeutic assessment is involved, and obtain specific advice for the exact transaction or venue.
