What changes when you turn 18?

Since 1 October 2024, people aged 18 and over can access certain therapeutic vapes from participating pharmacies without a prescription. The product must contain no more than 20 mg/mL nicotine, and the pharmacist must decide that it is clinically appropriate for smoking cessation or the management of nicotine dependence.

The pharmacist must verify the person’s identity and age, discuss other cessation supports, provide advice and comply with quantity and product requirements. A pharmacy may choose not to stock or supply vapes. Turning 18 therefore creates eligibility for a regulated pathway; it does not create a right to buy any vape from any seller.

Can an under-18 buy a vape with a prescription?

Commonwealth guidance says a person under 18 needs a prescription from a medical or nurse practitioner, where clinically appropriate and where state or territory law allows supply. A prescription does not permit purchase from a tobacconist, convenience store, ordinary vape shop or unapproved online retailer.

Local law can be stricter. Current TGA guidance identifies jurisdiction-specific restrictions. Victoria prohibits pharmacists from supplying vaping products to people under 18 even when a prescription exists. South Australia also prohibits sale or supply to a person under 18 regardless of a prescription. In other jurisdictions, the prescriber and pharmacist must check the rules that apply where the patient is located.

Is 18 the legal age to vape, possess a vape or buy one?

These are separate legal questions. Commonwealth law primarily regulates importation, manufacture and supply. State and territory laws can separately regulate possession by minors, use in smoke-free places, seizure, school rules and supply to young people.

A simple statement such as “the legal vaping age is 18 everywhere” leaves out important detail. Eighteen is the threshold for the national no-prescription pharmacy pathway, but under-18 prescription access and possession rules vary by jurisdiction. Where vaping is banned, the restriction applies regardless of the user’s age.

Where can an adult legally buy a vape?

Lawful consumer access is through a participating Australian pharmacy for smoking cessation or managing nicotine dependence. Ordinary retail sales are prohibited, including sales of products marketed as nicotine-free. The two main access routes are:
